1. INTRODUCTION
AND ACCEPTANCE These
Terms and Conditions (“Terms”) govern the use of the website https://edneirconstruction.com
(the “Site”). By accessing this Site, you agree to these Terms. The Site is
owned and operated by Kenneth E. Neir, doing business as Ed
Neir Construction, based in Vacaville, California.
2. NO
CONTRACTOR-CLIENT RELATIONSHIP
The
information provided on this Site is for general informational purposes only.
Your use of this Site, including contacting us via form or email, does
not create a contractor-client relationship. A binding agreement for
construction services only exists once a written contract (the “Prime
Contract”) is signed by both parties, in compliance with the California
State Contractors License Board (CSLB)
requirements.
3. LICENSING
AND PROFESSIONAL STANDARDS
Ed
Neir is an actively licensed, bonded, and insured General
Contractor and Electrical Contractor in the State of California (License No.
928715).
Permits: While we provide guidance,
per California Building Standards Code, the property owner is ultimately
responsible for ensuring all necessary building permits are obtained unless
otherwise specified in a signed written agreement.
o The
California Building Standards Code, found in Title 24 of the California Code of
Regulations, is a comprehensive set of regulations governing the design,
construction, and maintenance of buildings throughout the state. It is
published every three years by the California Building Standards
Commission (CBSC),
with 2025 being the latest triennial cycle.
Effective
Codes (2025 Cycle)

The 2025 California Building Standards Code was adopted to be published in
2025, with an effective date of January 1, 2026, for all new building
permit applications.

Previous
Cycle: Projects
submitted before January 1, 2026, generally fall under the 2022 California
Building Standards Code.
–
Model Codes: California's code
is based on national model codes (e.g., International Building Code,
International Residential Code) but
with specific amendments to meet California’s environmental and safety
conditions.
● Compliance: All project-related
communications via this Site are subject to the governing laws of the State of
California.
4. ESTIMATES
AND SERVICE DESCRIPTIONS
Any
"Free Estimates" or project galleries on this Site are illustrative
of past work and current capabilities.
Non-Binding: Online estimates or quotes
are preliminary and subject to a site visit, material cost fluctuations, and
architectural review.
Portfolio Rights: All project
photos on this Site are the intellectual property of Ed Neir Construction. You
may not use these images for commercial purposes or to represent your own work.
5. TERMS
AND CONDITIONS FOR REQUEST FORM SUBMISSION
Introduction: Thank you for your interest in submitting
a question or exploring a possible project with Ed Neir Construction. These
Terms and Conditions govern the submission of the request form and outline your
responsibilities and rights as you engage with our services.
Form
Submission: By
submitting the request form, you agree to provide accurate and complete
information as required by the form fields. The submission of this form does
not guarantee that your submitted question or project request will be approved
or that construction will commence. We will endeavor to respectfully answer any
questions submitted in a timely manner with the understanding that any online
estimates or quotes which may be provided are preliminary and subject to a site
visit, material cost fluctuations, and architectural review. ·
Use
of Information: The
information you provide through this form will be used solely for the purpose
of addressing any submitted questions or evaluating your project request and
managing our business relationship with you. Ed Neir Construction respects your
privacy and commits to protecting your personal information in accordance with
our Privacy Policy. ·

and Conditions shall be governed by and construed in accordance with the laws
of the jurisdiction in which Ed Neir Construction operates, Solano County
(please refer to item 10 below regarding GOVERNING LAW AND DISPUTE
RESOLUTION). Any disputes arising under these Terms shall be subject to the

6. LIMITATION
OF LIABILITY
Ed
Neir Construction’s liability regarding your use of this website (not
the physical construction work, which is covered by the Prime Contract) is
limited:
● No Warranties. To the fullest extent permitted by
applicable law, the services, information, and materials provided on this
website are provided on an "as is" and "as available" basis
without warranties of any kind, either express or implied. Ed Neir
Construction (the "Company") specifically disclaims all
warranties, including but not limited to, implied warranties of merchantability
or fitness for a particular purpose.
o Website
Accuracy: We do
not warrant that the descriptions, blog posts, or pricing on the Site are
error-free or up-to-date.
● Exclusion of Certain Damages. In no event shall the Company, its
owner, employees, or subcontractors be liable for any indirect, incidental,
special, consequential, or punitive damages. This includes, without limitation,
loss of profits, loss of use, business interruption, or loss of data, even if
the Company has been advised of the possibility of such damages.
● Liability Cap. To the maximum extent permitted by
law, the Company’s total aggregate liability for any and all claims, losses, or
damages arising out of or related to the use of this website or the services
described herein—whether in contract, tort (including negligence), or
otherwise—shall not exceed the total amount of fees paid by you to the Company
in the twelve (12) months preceding the event giving rise to the claim, or
$500, whichever is less.

limitations may not apply to you. In such cases, the Company’s liability will
